The Criminal Law (Domestic Violence) Amendment Act (No. 2) 2015 will introduce a new criminal offence into the Criminal Code. A person will offend the new section where they, unlawfully chokes, suffocates or strangles, without consent, another person who is in a domestic relationship with the perpetrator, or, the choking, suffocation or strangulation is associated domestic violence. The defence of provocation will have no application to the new offence and the offence will be a crime punishable by a maximum penalty of seven years imprisonment. Further, the Penalties and Sentences Act will also be amended in so far as when determining the appropriate sentence for an offender convicted of a domestic violence offence, a court must treat the fact that it is a domestic violence offence as an aggravating factor unless the court considers it not reasonable because of the exceptional circumstances of the case.
